Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of the website at nenurta.com, the AI chat assistant embedded on our pages, and the cybersecurity assessment tool at nist.nenurta.com (together, the "Services"), operated by Nenurta CyberTech ("we," "our," or "us"), located in Vancouver, British Columbia, Canada.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

Who May Use the Services

The Services are intended for business use by individuals who are at least 18 years old. By using the Services, you confirm that you are at least 18 and that, where you are acting for an organization, you have authority to accept these Terms on that organization's behalf. In that case "you" refers to both you and that organization.

Consulting Engagements Are Governed Separately

These Terms cover your use of our website and online tools only. Any consulting, advisory, assessment, or vCISO engagement we perform for you is governed by a separate written agreement, statement of work, or proposal signed by both parties. Where that agreement conflicts with these Terms, that agreement prevails for the services it covers.

Nothing on this website, and no output of our online tools, creates a consulting engagement or any advisory relationship between us. Submitting a contact form or completing an assessment does not obligate either of us to enter into an engagement.

Accounts

Our assessment tool requires an account. You agree to provide accurate registration information and to keep it current. You are responsible for all activity that occurs under your account and for keeping your sign-in email and any magic-link sign-in messages secure. Sign-in links and session tokens are personal to you and must not be shared. Please notify us promptly at info@nenurta.com if you believe your account has been accessed without your authorization.

We may suspend or terminate an account that we reasonably believe has been compromised, is being used in breach of these Terms, or has been inactive for an extended period.

Acceptable Use

You agree not to:

  • Use the Services in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to the Services, our accounts, our infrastructure, or any related systems or networks
  • Probe, scan, or test the vulnerability of the Services, or bypass any authentication, rate limiting, or other protective measure, without our prior written permission
  • Interfere with or disrupt the integrity or performance of the Services, including through automated request floods, denial-of-service techniques, or the introduction of malicious code
  • Scrape, harvest, or systematically extract content or data from the Services other than through ordinary browsing or with our written permission
  • Submit content that is unlawful, infringing, defamatory, or that contains personal information about other people which you have no right to share
  • Impersonate any person or organization, or misrepresent your affiliation
  • Resell, sublicense, or commercially exploit the Services or their output without our written permission
  • Use the Services, or our AI tools, to develop a competing product or to train a machine learning model

If you believe you have found a security vulnerability in our Services, we would rather hear from you than not: please report it to info@nenurta.com and give us a reasonable opportunity to respond before disclosing it.

AI Tools, Assessments, and Their Limits

Our assessment tool and AI chat assistant generate output automatically, using AI systems that can produce incomplete, outdated, or incorrect results. Please read the following carefully:

  • Output is informational only. Assessment results, scores, recommendations, and chat responses are provided for general guidance. They are not legal, regulatory, audit, financial, or professional advice, and they are not a substitute for a qualified professional reviewing your specific circumstances.
  • An assessment is not a certification or an audit. Our tool produces a self-assessment based on the answers you provide. It is aligned with recognized frameworks such as the NIST Cybersecurity Framework, but it is not an audit, attestation, certification, or accreditation, and it does not establish compliance with NIST CSF, SOC 2, ISO 27001, or any other standard. It will not satisfy an auditor, a regulator, or a customer requiring formal evidence.
  • Output depends entirely on your input. Results reflect what you tell us. Incomplete or inaccurate answers produce inaccurate results.
  • No guarantee of security outcomes. Following any recommendation from the Services does not guarantee that your organization will avoid a security incident, breach, or loss.
  • Verify before acting. You are responsible for independently evaluating any output before relying on it or acting on it.

Neither the assessment tool nor the chat assistant is monitored in real time. Do not use them to report a security incident or any urgent matter. If you are dealing with an active incident, contact us directly.

The chat assistant is an embedded service hosted on a separate domain by an external provider, and it loads only if you accept our consent banner. Please do not enter credentials, confidential business details, system configurations, or personal information about other people into the chat or into assessment responses. See our Privacy Policy for how this data is handled.

Your Content

You keep ownership of everything you submit to the Services, including your assessment responses, contact form messages, and chat messages ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, and transmit Your Content solely in order to operate the Services, generate your results, respond to you, and meet our legal obligations. This licence ends when Your Content is deleted, except for copies retained in routine backups or as required by law.

You are responsible for having the right to submit Your Content, and for ensuring it does not include personal information about other people that you are not permitted to share.

Our Content and Intellectual Property

The Services and all material we provide through them — including text, graphics, layout, logos, the Nenurta CyberTech name, assessment questions, scoring methodology, and report formats — are owned by us or our licensors and are protected by intellectual property laws. Framework names such as NIST CSF, SOC 2, and ISO 27001 belong to their respective owners, and our use of them does not imply their endorsement, affiliation, or accreditation.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access the Services and to use the assessment results generated for you internally within your own organization. All other rights are reserved. You may not copy, republish, redistribute, or create derivative works from our content without our written permission.

Third-Party Services and Links

The Services rely on third-party providers and may link to third-party websites. Those services and sites operate under their own terms and privacy policies, and we do not control them or take responsibility for their content, availability, or practices. Our Privacy Policy lists the providers we use.

Availability and Changes

We provide the Services on an as-available basis and may change, suspend, limit, or discontinue any part of them — including the assessment tool, the chat assistant, or any account — at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Services. We do not commit to any particular level of uptime and do not guarantee that stored assessment data will remain available indefinitely; please retain your own copy of any results you need.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that any output will be accurate, complete, current, or suitable for your circumstances.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms limits any non-excludable rights you have under consumer protection law.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER NENURTA CYBERTECH NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR CONTRACTORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES — INCLUDING ANY SECURITY INCIDENT, BREACH, OR LOSS SUFFERED AFTER RELYING ON OUTPUT FROM THE SERVICES — WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR ACCESS TO THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100). THE SERVICES DESCRIBED IN THESE TERMS ARE PROVIDED FREE OF CHARGE.

This section does not limit liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law. Liability for paid consulting engagements is governed by the separate written agreement covering that work.

Indemnification

You agree to indemnify and hold harmless Nenurta CyberTech and its directors, officers, employees, and contractors from any claims, damages, losses, liabilities, and reasonable legal costs arising out of your misuse of the Services, your breach of these Terms, your violation of any law, or your infringement of a third party's rights.

Termination

You may stop using the Services at any time, and may ask us to delete your assessment account as described in our Privacy Policy. We may suspend or terminate your access at any time if you breach these Terms or if we reasonably believe your use poses a risk to the Services or to others. The sections on Your Content, intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last Updated" date above. Changes take effect when posted, and your continued use of the Services after that constitutes acceptance. Please review these Terms periodically.

Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree that the courts located in Vancouver, British Columbia have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to their jurisdiction — except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory laws or the right to bring proceedings in the courts of your place of residence where applicable law grants you that right.

Before starting formal proceedings, we ask that you contact us at info@nenurta.com so we can try to resolve the matter informally.

General

  • Entire agreement: These Terms and our Privacy Policy are the entire agreement between us regarding the Services, and supersede any prior understanding on that subject.
  • Severability: If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions stay in effect.
  • No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • No third-party beneficiaries: These Terms do not create rights for anyone other than you and us.
